Pergola Permits in Italy 2026: Edilizia Libera and Its Limits
A bioclimatic pergola or a retractable-fabric pergotenda, attached or annexed to the house and without permanent enclosures, in many cases falls under edilizia libera, Italy's regime for works that need no building title: so says letter b-ter of article 6 of the Consolidated Building Act, introduced by the Salva Casa decree of 2024. Your municipality's regulations, landscape restrictions, condominium rules and distances from neighbours still apply, and a pergola permanently enclosed on all sides must be checked with the municipality. In this guide Michelessi, of Aprilia in Lazio, explains the conditions one by one and the check it carries out before ordering.

Do you need a permit for a bioclimatic pergola in Italy? The short answer
In many cases, no, provided the pergola meets the conditions of letter b-ter of article 6 of Italy's Consolidated Building Act (DPR 380/2001): a main structure made of fabric or movable louvres, attached or annexed to the building, no permanently enclosed space, and a visual impact kept to a minimum. When all those conditions are met, the work falls under edilizia libera and is carried out "without any building title": no CILA, no SCIA, no building permit.
The same article, however, preserves "the provisions of municipal planning instruments" and requires "compliance with" the Code of Cultural Heritage and Landscape: edilizia libera does not cancel municipal regulations, a landscape restriction, condominium rules or the distances from neighbours. That is why no flat answer exists: we set out the conditions and check them for you at the design stage, before ordering.
Edilizia libera and the Salva Casa decree: the text of letter b-ter
Letter b-ter was added to article 6 by Decree-Law no. 69 of 29 May 2024 (the "Salva Casa" decree), converted into Law no. 105 of 24 July 2024. The text in force on Normattiva, read in October 2026, says (our translation):
"works of protection from the sun and from the weather whose main structure consists of awnings, sun awnings, outdoor awnings, pergola awnings, including bioclimatic ones, with a retractable fabric, even waterproof, or with movable or adjustable solar-protection elements, attached or annexed to buildings or housing units, even with fixed structures needed to support and extend the work. In any case, such works may not create a permanently enclosed space with a resulting change in volume and floor area; they must have technical and aesthetic features that minimise visual impact and apparent bulk, and must harmonise with the existing architectural lines."
The words "including bioclimatic ones" were added when the decree was converted into law; the May 2024 decree did not contain them. In practice, a pergotenda with a folding fabric (retractable-fabric pergolas) is the "pergola awning with retractable fabric"; a bioclimatic pergola with rotating, or rotating and retracting, louvres (a "louvred", or in American English "louvered", pergola) is the one "with movable or adjustable solar-protection elements", and how it works is explained in bioclimatic pergola: what it is and how it works. Folding-arm and drop awnings are the first works named by the letter. The posts may be fixed, but the protection must stay movable.
The conditions for staying within edilizia libera, one by one
The word "bioclimatic" is not enough: a pergola falls under letter b-ter only if it meets all the conditions in the table together.
| Legal condition | What it means in practice |
|---|---|
| Main structure made of awnings or movable elements | The sun protection is the fabric or the louvres; the aluminium holds them up |
| Retractable fabric, or movable or adjustable louvres | The roof must be able to open; a fixed cover, even partial, does not qualify |
| Attached or annexed to the building | Serving the house, against a wall or in its immediate vicinity; not an isolated, self-standing structure |
| No permanently enclosed space | Movable side enclosures allowed, but the pergola must not become a room |
| Minimal visual impact, harmony with the building | Colour, height and proportions consistent with the façade |
The pergolas we sell and install, by Gibus, KE Outdoor Design and Pratic, have rotating louvres (for instance Gibus Twist, KE Kedry Prime, Pratic Opera), rotating and retracting louvres (Gibus Velvet, KE Kedry Skylife) or retractable louvres (Pratic Brera P), as declared by the manufacturers; the pergotende have a folding fabric roof. All have a movable protection; the other three conditions depend on your project, and we check them with you. To choose between the three brands, see our guide Gibus, KE or Pratic.
A bioclimatic pergola with glass walls: is a permit needed?
Sliding glass walls and zip screens are movable enclosures, allowed as long as the pergola does not become "a permanently enclosed space". Letter b-bis covers VEPA, removable and fully transparent panoramic glazing: it falls under edilizia libera on projecting balconies, recessed loggias and porticoes (excluding those of public use or facing public areas), if it serves a temporary purpose, creates no permanently enclosed space and guarantees "natural micro-ventilation".
The delicate point is enclosure on all sides. A pergola with glass and zip screens on every side, used all year round like a room, can become new volume: according to the engineering firm Studio Pagliai, the Genoa administrative court (TAR, ruling no. 862 of 2022) treated a bioclimatic pergola enclosed by folding glass walls as a veranda, and the courts' approach to side glazing is not uniform. That is why we design enclosures as protection from wind and rain on a pergola that remains open; if you want it permanently enclosed on all sides, the check with the municipality comes first, not afterwards. More in pergola enclosures, sliding glass walls and zip screens.
When a building title is needed: CILA, SCIA or building permit
A building title is needed when the work falls outside letter b-ter: a fixed roof, a permanent enclosure, an isolated and self-standing structure, or a significant impact on outline and elevation. The law then sees a canopy (tettoia), a veranda or a new construction, and the title (SCIA or the full building permit, permesso di costruire) depends on size and volume. The differences between the types are explained in bioclimatic pergola versus pergotenda, canopy, gazebo and veranda.
Two rulings of the Council of State, as reported by Biblus-ACCA (article of 15 April 2026), mark the boundary. In ruling no. 5918/2025, a structure with fixed posts, non-retractable slats and gutters, permanently installed on a terrace, was treated as a canopy, with added volume and a building permit required. In ruling no. 2293/2026 the judges recalled that canopies and bioclimatic pergolas are not automatically ancillary and, if they create new volume, count as "new construction". What counts is the effect, not the name; and since in the first case the slats were not retractable, the choice between rotate-only and retracting louvres is assessed on the project.
| What you want to build | How the law classifies it | What is needed, as a rule |
|---|---|---|
| Bioclimatic pergola with movable louvres or retractable-fabric pergotenda, wall-mounted, open | Letter b-ter, edilizia libera | No building title, subject to municipal rules, landscape and condominium |
| Pergola with openable glass and zip screens on some sides | Letter b-ter; for the glazing, b-bis may also apply | As above, but it depends on the design: we check it |
| Pergola permanently enclosed on all sides, used as a room | Veranda or new volume | Building title: check with the municipality |
| Fixed roof, even in part, or fixed slats on posts | Canopy (tettoia) | Building title (SCIA or permit, depending on size) |
The 2018 Glossary of edilizia libera: pergolas, gazebos and pergotende
Before the Salva Casa decree, the reference was the Glossary of edilizia libera (ministerial decree of 2 March 2018, Official Gazette no. 81 of 7 April 2018): a non-exhaustive list of 58 works that can be carried out under edilizia libera. It remains useful for structures not attached to the house: item 46 is the "Pergola, of limited size and not permanently fixed to the ground" (the gazebo, item 44, uses the same words), item 50 is "Awning, pergola awning, pergotenda, light furnishing cover".
The Glossary does not define "limited size" or "not permanently fixed": for a free-standing pergola the judgement rests with the municipality, and between wall-mounted and free-standing pergolas we prefer, where possible, the one annexed to the building.
Landscape restrictions: the coast, the Castelli Romani and historic centres
Edilizia libera is not freedom from landscape protection: article 6 applies "in compliance with" the Code of Cultural Heritage and Landscape (Legislative Decree 42/2004), and in a protected area landscape authorisation is as a rule required even for works that are free in building terms. In Lazio this may apply to seaside homes, historic centres, the Castelli Romani and parts of Rome: we read the map of restrictions, municipality by municipality. Presidential Decree no. 31 of 13 February 2017 distinguishes:
- Annex A, A.22: "installation of sun awnings on terraces, elevations or in private grounds", excluded from authorisation.
- Annex A, A.17: for bars, restaurants and tourist businesses, awnings, decking, windbreak panels and shading elements that are "easily removable", with no masonry and no permanent anchoring to the ground: excluded from authorisation.
- Annex B, B.17: canopies, porticoes and similar structures open on several sides, up to 30 square metres, under the simplified procedure.
- Bioclimatic pergola or pergotenda: no item of their own in Annex A; in a protected area, ordinary or simplified landscape authorisation is as a rule required, unless the municipality or the Soprintendenza reads the case differently.
The exclusion does not replace building titles or the public-land concession. For homes on the Lazio coast and in the Castelli Romani, the restriction check comes first in our design.
Municipal rules: building regulations in Aprilia, Rome and Latina
Municipal building regulations and planning instruments come before letter b-ter and may set sizes, distances, heights, colours and materials. There is therefore no single answer for the whole of Lazio: in Aprilia, when a filing is needed, it goes through the one-stop building office (SUE); in Rome, in Latina and elsewhere the local regulations apply. Before ordering, we read those of your municipality and, in doubtful cases, ask the municipal technical office for a written opinion.
For bars and restaurants a further title applies: the public-land occupation concession, with its fee and municipal regulation (in Rome, Capitoline Assembly Resolution no. 118 of 2025, with different rules for the historic city and the outer districts); beach clubs depend on the maritime-property concession and their own titles, as we explain in pergolas for restaurants, hotels and beach clubs. Seismic rules and, where required, the cadastral update also remain in force.
A pergola in a condominium: administrator, assembly and by-laws
In a condominium the Civil Code and the condominium by-laws apply too. On a privately owned terrace, article 1122 allows works that neither damage the common parts nor harm stability, safety and architectural decorum, but requires "prior notice to the administrator". On a common roof terrace or courtyard the work is a use of, or innovation to, a common part (articles 1102, 1117 and 1120): a resolution or consent is needed.
The condominium by-laws can be stricter than the law. As reported by CondominioWeb, the Court of Bolzano (ruling no. 633 of 24 July 2026) ordered the removal of a bioclimatic pergola on a private terrace, fixed to the common wall without the assembly's consent required by the contractual by-laws: edilizia libera does not cancel the limits of civil law. We always ask for the by-laws before quoting; the details are in our guide to a pergola on a condominium terrace.
Distances from boundaries, neighbours' windows and the road
A pergola with substance and stability may count as a "construction" for the purposes of distances. The Civil Code requires three metres between constructions, neither joined nor adjoining, on neighbouring plots (article 873), unless local regulations set a greater distance, and three metres from a neighbour's direct views (article 907). From the road: municipal regulations and the Highway Code, checked during the survey. Whether a pergola counts as a construction depends on the specific case: during the survey we measure boundaries, windows, the balconies of the floors above and the distance from the road, and design within your municipality's rules.
An outdoor kitchen under the pergola: what changes for permits
A stone kitchen under the pergola is presented as outdoor furnishing, like the barbecue and the fountain in the 2018 Glossary. Our outdoor kitchens have structures in refractory stone, steel or treated timber and worktops in granite, quartzite, sintered stone or marble; we do not build in concrete or masonry, and that helps on the permit side too: Studio Pagliai notes that concrete slabs and kerbs can be read as a permanent transformation of the ground.
One caution, raised by the same firm: if the pergola is enclosed on all sides and fitted with fixed services, air conditioning and kitchen units, the space may be regarded as in permanent use and fall outside edilizia libera. As reported by LavoriPubblici (3 July 2026), moreover, the courts assess the works together: pergola, glazing, paving and services. That is why we design pergola, kitchen and floor in the same drawing and, if the idea is a room closed in winter, we say so first and ask the municipality: see outdoor kitchen under a pergola.
How Michelessi works: we tell you at the design stage
Michelessi has worked stone in Aprilia, on the Via Pontina, since 1976, and in its pergola department sells and installs bioclimatic pergolas, pergotende, awnings and enclosures by Gibus, KE Outdoor Design and Pratic. The permit check, which we summarise below in five steps, is part of the survey, 3D design and installation, with the survey and the quotation free of charge throughout Lazio. Which title is needed, whether there is a restriction, what the condominium requires and how far from the boundary the pergola must stand: we tell you at the design stage.
For tax relief there is our guide to tax deductions for awnings and pergolas in Italy; for costs, how much a bioclimatic pergola costs; for a roof with solar panels, photovoltaic pergolas, whose electrical side has rules of its own; the department is on our Pergolas page. The 5-step permit check before ordering a pergola in Italy
- Where the pergola goes
Establish whether the pergola goes in the garden of a detached house, on a terrace or penthouse in a condominium, in a common courtyard, on public land or on state maritime property: each case has a different route and different titles. - Roof and enclosures
Check that the roof has movable louvres or a retractable fabric (letter b-ter) and is not fixed; decide whether the side enclosures will be absent, partial or on all sides, because a pergola permanently enclosed on all sides must be checked with the municipality. - Landscape restriction and municipal regulations
Read the map of landscape restrictions and your municipality's building regulations, which may set sizes, distances, colours and materials; in doubtful cases ask the municipal technical office for a written opinion. - Condominium and distances
Obtain the condominium by-laws, give prior notice to the administrator or seek a resolution if the pergola touches common parts; have boundaries, views, neighbours' windows and the distance from the road measured during the survey. - The outcome in the design
Have the classification entered in the design: edilizia libera, notice, CILA, SCIA or building permit, with landscape authorisation where needed, confirmed by a qualified technician or the municipality where necessary. Only then is the pergola ordered. We tell you at the design stage.

Frequently asked questions
Frequently asked questions
Do I need a permit for a bioclimatic pergola in Italy in 2026?
In many cases, no. Since 2024, letter b-ter of article 6 of DPR 380/2001 places louvred pergolas and retractable-fabric pergotende under edilizia libera, provided they are attached or annexed to the house, have no permanent enclosure and keep visual impact to a minimum. Municipal regulations, landscape restrictions, condominium rules and distances still apply: we check them at the design stage.
What does the Salva Casa decree say about pergolas?
Decree-Law 69/2024, converted into Law 105/2024, added letter b-ter to article 6 of Italy's Consolidated Building Act: sun-protection works made of awnings and pergola awnings, including bioclimatic ones, with retractable fabric or movable elements, attached or annexed to the building, are carried out without a building title, as long as they create no permanently enclosed space and harmonise with the building. Municipal regulations, landscape restrictions and condominium rules still apply.
Is a bioclimatic pergola with sliding glass walls still under edilizia libera?
It can be, if the glass walls remain movable enclosures on a pergola that does not become a room. Removable, transparent panoramic glazing (VEPA) has a letter of its own, b-bis. If instead the pergola is permanently enclosed on all sides and used all year round, it may be treated as new volume: in that case the check with the municipality must come before ordering.
When does a pergola become a canopy (tettoia)?
When the roof is fixed, even in part, or when the structure creates a permanent enclosed space. As reported by Biblus-ACCA, the Council of State (ruling no. 5918/2025) treated a structure with fixed posts, non-retractable slats and gutters on a terrace as a canopy requiring a building permit. What counts is the effect, not the name.
Do I need landscape authorisation for a pergola by the sea or in the Castelli Romani?
In a protected area, as a rule, yes, even if the work is free from the building point of view: edilizia libera applies in compliance with the Code of Cultural Heritage and Landscape. Presidential Decree 31/2017 excludes only certain works from authorisation, such as private sun awnings (item A.22). For the Circeo, Sabaudia, Gaeta, Sperlonga and the historic centres of the Castelli we read the map of restrictions municipality by municipality.
Can I install a pergola on my condominium terrace without asking the assembly?
On a privately owned terrace, article 1122 of the Civil Code requires no vote, but it does require prior notice to the administrator and respect for stability, safety and decorum. The condominium by-laws may however require the assembly's consent: as reported by CondominioWeb, the Court of Bolzano (no. 633/2026) ordered a bioclimatic pergola removed for exactly that reason. We always ask for the by-laws before quoting.
How far from the boundary, the neighbours' windows and the road must a pergola be?
The Civil Code provides for three metres between constructions, neither joined nor adjoining, on neighbouring plots (article 873), with local regulations able to require more, and three metres from a neighbour's direct views (article 907). From the road, municipal regulations and the Highway Code apply, checked during the survey. Whether a pergola counts as a construction depends on the specific case, so we give no single figure: during the survey we measure boundaries, windows, balconies and the distance from the road and design within your municipality's rules.
Does a free-standing pergola at the bottom of the garden fall under edilizia libera?
As a rule, not under letter b-ter, which requires a pergola attached or annexed to the house. It may fall among the furnishings of a building's grounds under the 2018 Glossary, item 46, if it is a pergola of limited size not permanently fixed to the ground, or among temporary works of up to 180 days with notice to the municipality. The judgement on size and anchoring rests with the municipality.
Do I need a permit for a folding-arm or drop awning?
Sun awnings are the first works named by letter b-ter: attached to the house, with a retractable fabric, they fall as a rule under edilizia libera. In a protected area, sun awnings on private terraces and elevations are also excluded from landscape authorisation (Presidential Decree 31/2017, item A.22). In a condominium the by-laws and decorum apply: colour, projection and model may be prescribed.
Can a restaurant put a pergola on the pavement or in a square?
Only with the concession for the occupation of public land, a title distinct from edilizia libera, with its own fee and municipal regulation: in Rome, Resolution no. 118 of 2025 of the Capitoline Assembly, with different rules for the historic city and the outer districts. On public land we design removable structures that are not permanently fixed to the ground; the filing goes through the Municipio or the municipality's one-stop office.
Does an outdoor kitchen under the pergola change anything for permits?
A kitchen in refractory stone, steel or treated timber, with a granite or quartzite worktop, is presented as outdoor furnishing, like the barbecue listed in the 2018 Glossary. Studio Pagliai warns, however, that a pergola enclosed on all sides and fitted with fixed services and kitchen units may be read as a space in permanent use: in that case we design with the municipality's opinion.
Who checks the permits if I buy my pergola from Michelessi?
Our technical office in Aprilia does, during the survey and the design: type of roof and enclosures, landscape restriction, municipal building regulations, condominium by-laws and distances. The classification, whether edilizia libera, notice, CILA, SCIA or permit, with landscape authorisation where needed, we tell you at the design stage, before the pergola is ordered, with the opinion of a qualified technician or the municipality where necessary. The survey is free of charge in Lazio.
